When saving on Samba get dialog replace existing newer file?

I know this has been posted before and I tried to follow the thread for 4 or 5 pages but I never saw it was resolved. I believe he resolved it with updating samba on Ubuntu.

Here is my problem.

When I edit on a Windows PC running XP and samba into my linux (fedodra 13) box running  samba-3.5.5-68.fc13.x86_64

When I edit and save the file I get the dialog File <path\file> is a new version. Replace existing newer file?

This does not happen for all files but once it starts happening it seems to persists.. I thought it was with files saved in the same minute but its more like the same day? or hour?.. I have set the linux box to the same time and behind and ahead with no luck. 

This DOES NOT happen if i save the file locally.

i set_var def_filetouch_checking to 1 which resolved the problem with asking if I wanted to update the file after losing buffer focus.

Please HELP.. This is very annoying.

To duplicate my issue

1) Open file on samba driver
2) click save (no dialog)
3) click save (dialog pops up)
4) click save (dialog pops up)
5) click save (dialog pops up)
